These Terms of Service (“Terms”) govern your use of the North Bay Grading and Paving website and the estimates, communications, and services we provide. North Bay Grading and Paving (“we,” “us,” or “our”) is a family-operated grading and asphalt paving contractor based in Santa Rosa, serving Sonoma County and nearby areas of Marin and Napa County, California. By using this website or requesting work from us, you agree to these Terms.

1. Use of this website

You may use this website to learn about our services, request a free estimate, and contact us. You agree not to misuse the site, attempt to disrupt it, or use it for any unlawful purpose. The content on this site, including text, images, logos, and graphics, is owned by or licensed to North Bay Grading and Paving and may not be copied or reused without permission.

2. Estimates and quotes

Estimates we provide are good-faith assessments based on the information available at the time. Final pricing may change if conditions differ from what was described or visible at the estimate, including:

  • Unforeseen site conditions such as soil, drainage, buried utilities, or existing base failure
  • Changes you request to the scope of work after the estimate is given
  • Access limitations, permits, or material cost changes outside our control

An estimate is not a binding contract. Work is scheduled and confirmed through a written agreement or work order before it begins.

3. Scheduling and weather

Grading and asphalt work depends on weather and site conditions. We may reschedule pours or grading to protect the quality of the finished work. We will make reasonable efforts to keep you informed of any changes to the schedule.

4. Payment

Payment terms, deposits, and schedules are set out in your individual estimate, work order, or contract. Unless stated otherwise, payment is due upon completion of the work. Late or unpaid balances may be subject to applicable fees as permitted by California law.

5. Workmanship and warranty

We stand behind our work and aim to build grading and pavement that lasts. Any specific warranty on materials or workmanship will be described in your written agreement. Asphalt is a natural material that ages with use, weather, and traffic; normal wear, hairline cracking, and color fading over time are not defects. Warranty coverage does not extend to damage caused by misuse, neglect, heavy loads beyond the surface’s design, settlement from soil conditions outside our control, or work performed by others.

6. Your responsibilities

To help your project go smoothly, you agree to:

  • Provide accurate information about the property and the work you want done
  • Confirm property lines and disclose known underground utilities, septic, irrigation, or drainage
  • Provide reasonable site access for crew and equipment
  • Keep vehicles, people, and pets off fresh asphalt and graded areas during the cure period we specify

7. Licensing

North Bay Grading and Paving is licensed, bonded, and insured to perform grading and paving work in California. License and insurance details are available on request.

8. Limitation of liability

To the fullest extent permitted by law, North Bay Grading and Paving is not liable for indirect, incidental, or consequential damages arising from the use of this website or from circumstances outside our reasonable control. Nothing in these Terms limits any rights you have under California law that cannot be waived.

9. Third-party links

This site may link to third-party services such as a map provider or our social media pages. We are not responsible for the content or practices of those sites.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Continued use of the site after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California. Any dispute relating to these Terms or our services will be handled in the courts located in Sonoma County, California.
